Robin Burgess and Tammy Sunvold Secure Summary Judgment in Medical Malpractice Case
Robin Burgess and Tammy Sunvold recently secured judgment in favor of their client/physician from a 5-year long medical malpractice lawsuit. The judge agreed that Plaintiff’s expert was not qualified to offer standard of care testimony against the client/physician and granted summary judgment. However, the judge also granted Plaintiff leave to obtain a new standard of care expert, which Plaintiff did. Ms. Burgess and Ms. Sunvold filed a follow-up motion seeking reconsideration of the court’s ruling which permitted Plaintiff to substitute an expert, based on the lack of justice and fairness that would result. After full briefing and oral argument, the court recognized the substantial prejudice to the Firm’s client/physician and granted summary judgment.
