On January 30, 2014, Sanders & Parks shareholder Mark Worischeck was a featured presenter at the Inaugural Insurance Law Institute sponsored by the State Bar of Arizona. Mark presented on bad faith, including workers' compensation bad faith.

Shareholder Mark Worischeck was invited by the Claims & Litigation Management Alliance ("CLM") to participate as a panel member at its 2014 Annual Conference in Boca Raton, Florida. The panel presentation, entitled The Millenials in Action: Lessons Learned about Juror Decision Making from Mock Trials focused on Millennials as jurors and how they make decisions regarding liability, causation and damages.

Shareholder, Mandi J. Karvis, has become a contributing writer for the online publication Physician's Money Digest. Physician's Money Digest is a financial resource for physicians covering personal finance, investing, retirement planning, practice management and lifestyle. The site publishes daily news, advice and columns from current and former MDs, attorneys, financial advisors and health care reporters. Ms. Karvis' first article " Preparing to be Deposed" is a multi-part series to help physicians understand what to do if their deposition is requested. Ms. Karvis will publish one article per month.


Shareholder Mandi Karvis has been elected to the Board of Directors of WESTMARC-Western Maricopa Coalition. Ms. Karvis is a resident of the West Valley and is excited to help WESTMARC further their mission to promote the West Valley and advocate on its behalf. In addition to serving on the Board of Directors, Ms. Karvis also serves on the Healthcare Committee.


On February 21, 2013, Sanders & Parks Shareholders along with attorney and licensed real estate broker Mark Kramoltz of SimplySOLD ND Realty, with the assistance of Sanders presented a CLE program on "Real Estate Agents, Duty and Disclosure" to the Real Property Section of the State Bar of Arizona. This well-attended seminar focused on potential legal pitfalls and problems arising from Real Estate purchase contracts , Real Estate Agent dual agency, disclosure obligations, and recent developments in the relevant case law. Sanders & Parks served as a sponsor for the Midwestern University Bright Lights Shining Stars Gala in October 2012. The purpose of the event is to award Spirit of Service scholarships to Midwestern University students. The Spirit of Service scholarship program recognizes outstanding Midwestern University students based on community service, leadership abilities, academic standing, and financial need. The event raises over $100,000 annually in scholarship funds for students in all of Midwestern University's colleges.

On September 21, 2012, Sanders & Parks shareholders Artie Eaves, along with paralegal Jeanne Beasley and Dr. James Mankin, a trauma surgeon at St. Joseph's Medical Center, conducted an all-day training session on medical records and trial software at the Phoenix School of Law for members of the Maricopa County Attorney's Office. Mr. Eaves was asked by Bill Montgomery, the Maricopa County Attorney, to make the presentation in order to assist the County Attorney's Office with the effective use of medical records and trial software in the prosecution of criminal cases. The presentation was met with many thanks and compliments. We hope it will result in enhancements to the County Attorney's ability to effectively handle criminal prosecution on behalf of the residents of Maricopa County.


On August 30, 2012, Mark Worischeck participated as a panel member at the State Bar of Arizona's daylong seminar on Bad Faith Insurance Law. Mark presented the defense perspective on workers' compensation bad faith which included such topics as the Concurrent Jurisdiction of the Superior Court and the Industrial Commission of Arizona ("ICA"); Administrative Bad Faith in the ICA; the Carrier's Duty to Investigate; and Potential Defenses to Workers' Compensation Bad Faith.


In July 2012, Mark Worischeck and J. Steven Sparks settled a personal injury action on behalf of a family from the San Carlos Apache Indian Reservation who suffered life-changing injuries when a tractor-trailer collided with their pickup truck while attempting an unsafe, high-speed passing maneuver on Highway 70. Two young family members -- who were unrestrained in the cargo bed of a pickup truck -- sustained traumatic brain injuries and massive orthopedic injuries. The case ultimately settled in the high seven figures.


On August 16, 2012, at the request of Fireman's Fund Insurance Company, Mark Worischeck gave a nationwide presentation entitled "The Peculiarities of Arizona Insurance Law" which covered such areas as insurance bad faith, Damron/Morris agreements and reservation of rights. The presentation was given at Fireman's Fund's corporate headquarters in Novato, California to corporate executives and webcast throughout the United States to Fireman's Fund's adjusters and claims representatives.


Shanks Leonhardt won a significant victory at the Arizona Court of Appeals that established personal jurisdiction over a foreign manufacturer in a product liability case when the manufacturer's products entered Arizona through the "stream of commerce." This is Arizona's first published decision addressing personal jurisdiction based on the "stream of commerce" since the U.S. Supreme Court's recent decision in J. McIntyre Machinery, Ltd. v. Nicastro, 131 S. Ct. 2780 (2011) and since the Arizona Supreme Court's landmark decision in A. Uberti & C. v. Leonardo, 181 Ariz. 565, 892 P.2d 1354 (1995).

Mark Worischeck and Garrick Gallagher were named as Top Lawyers for 2011 by the North Valley Magazine.


Rick Bryson was awarded the Distinguished Service Award by the J. Reuben Clark Law Society, Phoenix, Arizona Chapter for Rick's and the firm's contributions to Bringing Hope to Single Moms Arizona Foundation. Bringing Hope to Single Moms Arizona Foundation provides education and access to resources to single mothers and their children. Rick co-founded and served as President and Chairman of Bringing Hope to Single Moms Arizona, and the firm provided on-going support for the organization for several years.


Rick Bryson was a presenter at Brigham Young University J. Reuben Clark Law School's 2010 Annual Conference. Rick spoke on Doing Service for Good through Law and shared experiences in which the law and legal training have led to positive societal outcomes. Mark Worischeck, owner and director of the Firm, negotiated significant settlements on behalf of the surviving family members of two men killed in separate aviation accidents. In the first, a passenger in a single-engine kitplane was killed when the aircraft struck high tension power lines. The passenger left a surviving wife and two young children. Among other things, the settlement allows the surviving spouse to return to college, and establishes trust funds for the surviving children.

In the second case, a pilot on a training flight was killed in Oregon when the port wing separated from the aircraft in flight. The highly-favorable settlement also will provide much-needed stability for the decedent's survivors, including his wife and two daughters.

On August 7, 2009 Sanders & Parks was ranked fourth in the Phoenix Business Journal's list of top Specialty Law Firms in the Valley. While we are a full-service civil law firm, Phoenix Business Journal particularly noted our work in aviation, professional malpractice, product liability, insurance coverage, civil litigation, and intellectual property.


Mark Worischeck and J. Steven Sparks obtained a favorable decision in a 9th Circuit appeal. In Biltmore Associates, LLC v. Twin City Fire Insurance Company, et al., the Court affirmed the dismissal of Plaintiff's case against our insurer client because the insured-versus-insured exclusion barred coverage for claims by the Plaintiff. The application of the insured-versus-insured exclusion in this context was a matter of first impression in the 9th Circuit and was resolved favorably to our insurer. Read the decision here.


Mark Worischeck obtained a judgment in favor of the State Compensation Fund, the leading provider of workers' compensation insurer in the state. In a ruling that is the first of its kind in Arizona, and possibly nationwide, the Court found that the State Compensation Fund does not have to pay full-bill charges for services provided at ambulatory-care centers for insured employees who are injured. Robert Bruno wrote a comprehensive article for the Professional Liability Underwriting Society Journal relating to Damron agreements in Arizona. Mr. Bruno, a trial lawyer with more than 35 years of experience in civil practice, comments on the dangers of an insurer denying coverage to an Arizona insured exposed to a third party liability claim and advocates that Arizona should recognize a reasonableness requirement on any stipulated judgment between an insured and a third party.
